Terms of Service
Last updated: May 12, 2026
The service
Winkly is an AI-powered activity planning service operated by Phillip Ocasio. By using trywinkly.com, you agree to these terms. If you don't agree, please don't use the service.
What we provide
Winkly generates personalized activity recommendations based on the information you provide. Plans are delivered by email and are intended as suggestions — we make our best effort to recommend appropriate, available venues and activities, but we cannot guarantee:
- That a venue is open on the date you've selected
- That prices, hours, or availability are current
- That an activity is suitable for every member of your group
- That outdoor activities will not be affected by weather
Always verify venue details before you go. We're a starting point, not a booking platform.
Your responsibilities
You agree to:
- Provide accurate information when requesting a plan
- Use the service for personal, non-commercial purposes
- Not attempt to reverse-engineer, scrape, or abuse the service
- Not use the service to generate content for redistribution or resale
Accounts
Creating a Winkly account is optional. If you create one, you are responsible for keeping your sign-in link confidential. Magic links expire after 1 hour. Contact trywinkly@gmail.com if you believe your account has been accessed without your permission.
Paid plans
Winkly currently offers a free tier. Paid subscription tiers may be introduced in the future. If and when paid plans launch, pricing, billing terms, and cancellation policies will be disclosed clearly before any charge is made.
Limitation of liability
Winkly is provided “as is.” We are not liable for any direct, indirect, or incidental damages arising from your use of the service, including but not limited to a venue being closed, an activity not going as planned, or reliance on incorrect information in a generated plan.
Changes to these terms
We may update these terms from time to time. If we make material changes, we'll update the date above. Continued use of the service after changes means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict of law principles.
